TERMS & CONDITIONS – PERFUME WORKSHOPS

These Terms & Conditions (“Terms”) apply to all perfume-making workshops, private events, group bookings and related services provided by Scent with Love, trading as Scent with Love London (“we”, “us”, “our”).

By booking, paying for, attending or participating in a workshop, the person making the booking and, where applicable, each participant agrees to these Terms.

1. WORKSHOP NATURE

Our workshops are recreational and educational experiences in which participants are guided through the process of creating their own fragrance.

Participants may handle, smell and combine fragrance oils, aroma materials, alcohol-based products and other ingredients commonly used in perfumery.

The final fragrance is individually created by or for the participant. Results will therefore vary and are inherently subjective.

We do not guarantee that a participant will like a particular fragrance, formulation or final result.

2. HEALTH, ALLERGIES AND SENSITIVITIES

Fragrance materials may contain substances capable of causing allergic reactions, irritation, headaches, respiratory discomfort or other sensitivities in certain individuals.

Participants are responsible for considering whether participation is suitable for them.

Before participating, attendees must inform us of any known allergies, sensitivities, medical considerations or other circumstances that could reasonably affect their safe participation.

We may advise a participant not to use certain materials or may refuse or discontinue participation where we reasonably consider this necessary for health or safety reasons.

Unless caused by our negligence or another liability that cannot lawfully be excluded, we accept no responsibility for reactions arising from an allergy, sensitivity, intolerance or medical condition that was unknown to us or not disclosed before or during the workshop.

Participants must immediately stop using any ingredient and notify the workshop host if they experience discomfort or an adverse reaction.

3. USE OF THE FINISHED PERFUME

A fragrance created during a workshop is intended primarily as the participant’s personalised workshop creation.

Participants are responsible for how they subsequently store and use their fragrance.

We recommend avoiding contact with the eyes, mouth, broken or irritated skin and keeping fragrance products away from children, pets, flames, heat and other ignition sources where applicable.

Participants must follow any safety or usage instructions provided by us.

Unless expressly agreed otherwise in writing, fragrances created by participants during workshops are not supplied or certified by us for commercial resale, mass production, therapeutic use or any other regulated commercial purpose.

4. PARTICIPANT RESPONSIBILITY

Participants must:

• follow all reasonable instructions given by our workshop team;

• use materials and equipment only as instructed;

• behave responsibly and with reasonable care;

• immediately notify us of spills, breakages or accidents;

• not intentionally misuse fragrance ingredients, alcohol, equipment or other workshop materials; and

• not engage in conduct that creates a risk to themselves, other participants, our staff, the venue or property.

We may suspend or terminate a participant’s involvement without refund if their behaviour is unsafe, abusive, disruptive, intoxicated or materially interferes with the workshop or other guests.

5. MINORS

Participants under the age of 12 must be accompanied by an adult, or may only attend where this has been expressly permitted by us.

Where required by us, a parent or legal guardian must remain present and supervise the minor throughout the workshop.

The parent, guardian or responsible adult is responsible for ensuring that the minor follows all workshop instructions.

6. BOOKINGS

A booking is only confirmed once we have accepted the booking and received any payment or deposit required by us.

The person making a group booking is responsible for:

1. providing accurate booking information;

2. communicating these Terms and relevant safety information to all participants; and

3. ensuring that participants are aware of the date, time, location and workshop requirements.

7. CANCELLATIONS BY THE CUSTOMER

Our workshops involve reserving a specific date, time, host capacity, venue capacity and materials.

Subject to any mandatory rights that apply under law, our cancellation policy is:

More than 14  working days before the workshop: rescheduling permitted

Less than 14 working days before the workshop: no refund and no rescheduling.

No-show: no refund and no rescheduling.

Where we allow a customer to reschedule as a goodwill gesture, the replacement date is subject to availability and may be subject to an administration fee.

A booking cannot be repeatedly rescheduled.

8. LATE ARRIVALS

Participants should arrive at the time stated in their booking confirmation.

Where a participant arrives late, we will use reasonable efforts to allow them to join the workshop, but we are not required to extend the workshop or repeat content already delivered.

Significant lateness may result in participation being refused where allowing entry would disrupt the workshop or create a safety issue.

No refund will normally be provided for lost workshop time caused by a participant’s late arrival.

9. CANCELLATION OR CHANGES BY US

We may make reasonable changes to the workshop where necessary, including changes to the host, materials, fragrances, room layout or venue within a reasonable geographical area.

We may cancel or reschedule a workshop because of circumstances including illness, venue problems, safety concerns, insufficient attendance or events outside our reasonable control.

Where we cancel a workshop and cannot provide a reasonable alternative, customers will be entitled to a refund of the amount paid to us for the affected workshop.

Unless required by law, we are not responsible for indirect costs incurred by participants, including travel, accommodation, childcare or loss of earnings.

10. FORCE MAJEURE

We will not be responsible for delay, cancellation or failure to perform caused by circumstances outside our reasonable control.

These circumstances may include severe weather, transport disruption, fire, flood, governmental restrictions, public health events, strikes, venue closure, utility failures, security incidents or other comparable events.

Where reasonably possible, we may offer an alternative date, credit or other reasonable solution.

Nothing in this clause removes rights that cannot legally be excluded.

11. DAMAGE TO PROPERTY

Participants are responsible for taking reasonable care of our premises, third-party venues, materials and equipment.

Where a participant intentionally or negligently causes damage beyond reasonable wear and tear, we reserve the right to recover the reasonable cost of repair or replacement from that participant or, where appropriate, the person responsible for the booking.

12. PERSONAL BELONGINGS

Participants remain responsible for their own coats, bags, jewellery, phones and other personal belongings.

We accept no responsibility for loss, theft or damage to personal belongings unless caused by our negligence or where liability cannot lawfully be excluded.

13. PHOTOGRAPHY AND VIDEO

We may take photographs or videos during workshops for our website, social media or promotional materials only where we have an appropriate lawful basis to do so.

Where consent is required, participants may decline photography or filming.

We will not make participation conditional upon consenting to promotional photography unless this has been clearly agreed as an essential part of a specifically organised event.

14. INTELLECTUAL PROPERTY

Our workshop materials, teaching methods, written content, branding, photographs, templates, fragrance concepts and other proprietary materials remain owned by us or our licensors where applicable.

Participation in a workshop does not transfer any intellectual property rights to participants.

Workshop materials may not be reproduced, distributed, commercially exploited, taught, published or repackaged without our prior written permission, except where permitted by law.

A participant remains free to enjoy and use the personal fragrance they create during the workshop.

15. LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability which cannot legally be excluded or restricted.

Subject to the above, we will not be liable for losses that were not reasonably foreseeable when the contract was entered into.

We will not be liable for business losses suffered by a consumer, including loss of profit, revenue, business opportunity or anticipated savings, where the workshop was purchased wholly or mainly for private purposes.

We are not responsible for adverse outcomes resulting from:

• a participant failing to follow safety instructions;

• undisclosed allergies or sensitivities;

• deliberate or reckless misuse of materials;

• use of the finished fragrance contrary to instructions;

• modification or contamination of the fragrance after the workshop; or

• circumstances outside our reasonable control,

except to the extent that the loss was caused by our breach of contract, negligence or another liability which cannot lawfully be excluded.

Where permitted by law, our liability relating to a workshop will not exceed the amount paid to us for the affected booking, except where such a limitation would be unlawful or unfair under applicable consumer law.

16. NO MEDICAL OR PROFESSIONAL ADVICE

Information provided during our workshops concerning fragrance materials, ingredients, sensitivities or product use is provided for general workshop and safety purposes only.

It does not constitute medical, dermatological or other professional healthcare advice.

Participants with concerns regarding allergies, asthma, skin conditions or other medical issues should obtain appropriate professional advice before participating where necessary.

17. THIRD-PARTY VENUES

Some workshops may take place at hotels, restaurants, event spaces or other third-party venues.

Participants must comply with reasonable venue rules.

We are not responsible for acts or omissions of an independent third-party venue except where we have legal responsibility for them.

We ask customers to contact us as soon as reasonably possible so that we have an opportunity to investigate and resolve the issue.

19. PERSONAL DATA

We process personal information in accordance with applicable UK data protection legislation and our Privacy Notice.

Our Privacy Notice explains, among other things, what personal information we collect, why we use it, the legal bases on which we rely, how long information is retained, with whom it may be shared and the rights available to individuals.

20. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect so far as permitted by law.

21. NO WAIVER

If we do not immediately enforce a right under these Terms, this does not mean that we have waived that right.

22. THIRD-PARTY RIGHTS

Unless expressly stated otherwise, a person who is not a party to the contract has no right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.

23. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of England and Wales.

Where the customer is a consumer, nothing in this clause deprives them of any mandatory consumer protection or jurisdictional rights that apply to them under applicable law.

Subject to such mandatory consumer rights, the courts of England and Wales shall have jurisdiction in relation to disputes arising from these Terms.

24. CHANGES TO THESE TERMS

We may update these Terms from time to time.

The version applicable to a booking will normally be the version made available to the customer at the time the booking was entered into, unless a change is required by law or expressly agreed between us.
